What Are DUI Charges in Arizona?

Is a DUI a felony in Arizona? In Arizona, DUIs are taken seriously and can be charged as misdemeanors or felonies. Most DUIs come with an automatic 90-day license suspension and 8 points against your license in addition to other penalties. DUIs are separated into four categories, which are:

Standard DUI

In Standard DUIs, blood alcohol concentration (BAC) is generally in the .08% to .15% range. The penalties for a Standard DUI can include:

• 12-month requirement for an Ignition Interlock device (IID).
• Required Traffic Survival School.

In some cases, the IID requirement can be shortened to six months.

Extreme DUI

In Extreme DUIs, BAC is generally between .15% and .20%. The penalties can include:

• 12-month requirement for an IID.
• Required Traffic Survival School.

Super Extreme DUI

In Super Extreme DUIs, BAC is generally .20% or higher. The penalties can include:

• 18-month requirement for an IID, if it is a first offense.
• 24-month requirement for an IID, if it is a second offense within seven years.
• Required Traffic Survival School.

Aggravated DUI

In Aggravated DUI cases, other factors are also in play. These include: driving the wrong way down a street, having a passenger in the car who is under 15 years of age, driving with a suspended license, or driving while having an IID installed in the vehicle.

The penalties are:

• One-year revocation of your driver’s license. You will need to reapply for your license.
• Required IID for 12-24 months.
• Required Traffic Survival School.

Multiple DUIs

When you have had multiple DUIs, there are additional penalties.

• Second offense: Your license is revoked for a year, and you are required to use an IID for 12-24 months.
• Three or more offenses: Your license is revoked for three years, and you are required to use an IID for 12-24 months.

Commercial Drivers

If you carry a commercial driver’s license, then you may face additional penalties. These are:

• CDL is disqualified for one year if you are in a passenger vehicle and your BAC is .08% or higher.
• CDL is disqualified for one year if you are in a commercial vehicle and your BAC is .04%.

Drivers Who Are Under 21

What happens if you get a DUI under age 21 in Arizona? Arizona follows a “Not a Drop” law. This means that if you are under 21 and have any amount of alcohol in your blood, you will face penalties like:

• Up to 6 months in jail.
• Up to $2,500 in fines.
• Mandatory community service, alcohol counseling, and/or education classes.
• One-year requirement for an IID.
