Understanding DUI, Extreme DUI, and Super Extreme DUI in Arizona

Driving under the influence (DUI) is a serious offense in Arizona, with stringent laws and severe penalties. Understanding the differences between DUI, Extreme DUI, and Super Extreme DUI can help you navigate these complex legal issues. In this blog post, we'll explore each type of offense, the associated penalties, and the importance of having experienced legal representation on your side.

What is DUI in Arizona?

Arizona has some of the most strict DUI laws in the nation. Arizona actually breaks down DUI into several levels with each level being its own separate criminal charge.

First, there’s DUI Impairment to the Slightest Degree. Most are not aware of this but in Arizona if you are stopped by the police and they detect alcohol has impaired your ability to drive to the slightest degree, you can actually be charged with a DUI. Yes, even if your blood alcohol level in your body is under the legal limit of .08%.

Next, there is the standard DUI in Arizona which occurs when a driver is found to have a blood alcohol concentration (BAC) of 0.08% or higher. For commercial drivers, the limit is 0.04%, and for drivers under 21, any detectable alcohol can result in a DUI charge.

Penalties for Standard DUI

First-time offenders face:

  • Up to 10 days in jail
  • Fines and fees up to $1,500
  • Probation
  • Mandatory alcohol education and screening
  • License suspension for 90 days up to 1 year

What is Extreme DUI?

Extreme DUI is a more severe charge, applied when a driver's BAC is 0.15% or higher within two hours of driving. The penalties for Extreme DUI are significantly harsher due to the increased risk posed by such high levels of impairment.

Penalties for Extreme DUI

First-time offenders face:

  • Up to 30 days in jail
  • Fines and fees up to $2,700
  • Mandatory alcohol education and treatment
  • One-year installation of an ignition interlock device
  • License suspension for 90 days up to 1 year

What is Super Extreme DUI?

Super Extreme DUI is the most severe DUI charge in Arizona, given when a driver's BAC is 0.20% or higher. The consequences of a Super Extreme DUI are the most stringent, reflecting the heightened danger to public safety.

Penalties for Super Extreme DUI

First-time offenders face:

  • Up to 45 days in jail
  • Fines and fees up to $3,200
  • Mandatory alcohol education and treatment
  • 18-month installation of an ignition interlock device
  • License suspension for 90 days up to 1 year
