Wartime veterans, 65 years and older, and their surviving spouses, may be entitled to a tax-free benefit called Aid and Attendance provided by the Department of Veteran Affairs (VA). The Benefit is designed to provide financial aid to help offset the cost of long-term care for those who need assistance with the daily activities of living such as bathing, dressing, eating, toileting, and transferring. Who Qualifies for Veterans Aid?

What War Time Qualifies:

WWII: December 6, 1941 – February 31, 1946

Korea: June 26, 1950 – January 31, 1955

Vietnam: August 5, 1964 – May 7, 1975 AND

February 28, 1961 – May 7, 1975

Gulf Conflict: August 2, 1990 – Present

*The Veteran must have served at least 90 days of active duty, with at least 1 day during wartime listed above

*The Veteran must be at least 65 years of age OR 100% disabled

*The Veteran must have not received a dishonorable discharge

Must need assistance with at least 2 of the following Activities of Daily Living (ADL’s)

Transferring (moving from bed/chair)

  • Walking
  • Dressing
  • Eating
  • Bathing

Who can be a guardian?

When deciding who might serve as guardian once the need for guardianship has been established, the court generally appoints the person they believe will act in the minor, elder, or incapacitated person’s best interests.

How long does a guardianship last?

After the court has established guardianship, the guardianship will remain in place until the court grants a petition to end the guardianship.
